During the determination process Landgage Heritage successfully argued that no further archaeological works were required, and contributed to collaborative design discussions with the local planning authority to improve the design of the scheme.
Despite this, the local authority refused the scheme, and cited harm to the Hertford Conservation Area and nearby listed buildings as one of the reasons for refusal. The client decided to pursue an appeal to challenge this decision.
Landgage Heritage provided expert witness services for the appeal. The appeal procedure was a planning inquiry. Services provided by Landgage included the production of a heritage proof of evidence and giving evidence at the inquiry. Prior to the inquiry Landgage worked closely with the planning barrister and the scheme architects to ensure the case being defended was reasonable and robust.
After hearing the evidence the planning inspector agreed with our position that the scheme would preserve the significance of the conservation area and nearby listed buildings. For this and other reasons the refusal was reversed and the appeal was allowed.
